One of two men accused of bashing and robbing two French male tourists in Papamoa in July is is seeking to have the charges thrown out claiming there is no evidence to convict him.

Che Bridger, 24, from Mount Maunganui, who has denied two charges of aggravated robbery, was back in Tauranga District Court yesterday for a pre-trial hearing.

His lawyer, Tony Balme, told Judge Bidois the prosecution evidence was ''quite inadequate''.

Bridger, who remains in  custody, is due back in court in February 4, 2013 for a trial callover hearing.

The other man is to be sentenced next week.
